Calgary Walk to Remember Waiver
I acknowledge that myself and my family, including my minor children, are aware that the Calgary Walk to Remember is a community event, that it is being held in a public venue and that the Calgary Walk to Remember committee and volunteers, and any other volunteers are NOT responsible for myself and my partners’ well-being, safety and liability, as well as my minor children’s well-being, safety and liability during the time of the walk. I/WE do not hold any of the above individuals, the organizations or any other participants responsible for any mishaps or mistakes that may take place during the Calgary Walk to Remember. This event is a public event, and may have animals/pets present. I acknowledge that the Calgary Walk to Remember and its affiliates are also not responsible for any allergies or bites that could result in being in a public area where pets are present. Images may be recorded through the afternoon for publication on our website and Facebook page. Every effort will be made by our professional photographers to capture simple shots, at the same time, respecting the privacy of all attendees.
In consideration of the The Calgary Walk to Remember, The City Of Calgary Park Division, and the staff and volunteers of the above programs (hereinafter “The Event Organizers”) agreeing to allow me to participate in the 2021 Calgary Walk to Remember on September 11th,(the “Event”), I, for myself, my heirs, executors, administrators or assigns, or, in the case of a minor as his or her legal guardian:
The Calgary Walk to Remember is committed to following all public health measures and restrictions in regards to Covid-19. The following changes to our regular event have been made in order to ensure we are doing our part to limit the transmission.
In consideration of my participation in the foregoing, the undersigned acknowledge and agree to the following:
Following the pronouncements above I hereby declare the following:
By accepting this waiver I acknowledge that I have read the foregoing Liability Release Waiver and understand its contents; that I am at least eighteen (18) years old and fully competent to give my consent; That I have been sufficiently informed of the risks involved and give my voluntary consent in signing it as my own free act and deed; that I give my voluntary consent in signing this Liability Release Waiver as my own free act and deed with full intention to be bound by the same, and free from any inducement or representation.
This waiver will remain effective until laws and mandates relevant to COVID-19 are lifted.
In consideration of the The Calgary Walk to Remember, The City Of Calgary Park Division, and the staff and volunteers of the above programs (hereinafter “The Event Organizers”) agreeing to allow me to participate in the 2021 Calgary Walk to Remember on September 11th,(the “Event”), I, for myself, my heirs, executors, administrators or assigns, or, in the case of a minor as his or her legal guardian:
- RELEASE the Event Organizers, its directors, officers, servants, employees, agents, agencies, affiliates, sponsoring companies or benefitting organizations from any claims, demands, damages, actions or causes of actions arising out of or in consequence of any loss, injury, death or damage to my person or property incurred while participating in the Event notwithstanding that any such loss, injury, death, or damage may have arisen by reason of the negligence of the Event Organizers, its servants, agents, or employees;
- Fully understand the risks and dangers of participating in the Event and accept these risks and dangers entirely at my own risk;
- Fully understand that my participation in the Event, or any component of the Event, is voluntary;
- Agree to indemnify the Event Organizers, its servants, agents or employees from any claims or demands, which might be made against the Event Organizers arising out of, or in consequence of, my participation in the Event;
- Represent that I am the full age of eighteen (18) years or older. If I am a minor, my legal guardian has signed this release on my behalf.
- I give full permission for the use of my name, photographs, electronic and video image to recognize my participation in and promote the Calgary Walk to Remember.
The Calgary Walk to Remember is committed to following all public health measures and restrictions in regards to Covid-19. The following changes to our regular event have been made in order to ensure we are doing our part to limit the transmission.
- There will not be any use of the washrooms, so please plan ahead
- There will not be any food available
- There will not be any stations this year, as they are considered a high-touch area
- The walk this year will be one way to allow for 6ft to be maintained between other households and groups
- Time slots will be allotted to control the amount of people we have on the pathway at one time
- Only registered participants will be allowed to participate in the walk so that numbers can be maintained and public health orders can be followed.
In consideration of my participation in the foregoing, the undersigned acknowledge and agree to the following:
- I have not experienced symptoms such as fever, fatigue, difficulty in breathing, or dry cough or exhibiting any other symptoms relating to COVID-19 or any communicable disease within the last 14 days.
- I have not, nor any member(s) of my household, traveled by sea or by air, internationally within the past 30 days.
- I did not, nor any member of my household, visit any any area that was reported to have an outbreak of COVID-19, in the last 30 days
- I have not been, nor any member(s) of my household, diagnosed to be infected of COVID-19 virus within the last 30 days.
Following the pronouncements above I hereby declare the following:
- I am fully and personally responsible for my own safety and actions during my participation, and I recognize that I may in any case be at risk of contracting COVID-19.
- With full knowledge of the risks involved, I hereby release, waive, discharge the Organization, The Calgary Walk to Remember, its board, officers, independent contractors, affiliates, employees, representatives, successors, and assigns from any and all liabilities, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, injury, or death, that may be sustained by me related to COVID-19 while participating in any activity while in, on, or around the premises or while using the facilities that may lead to unintentional exposure or harm due to COVID-19.
- I agree to indemnify, defend, and hold harmless the Organization from and against any and all costs, expenses, damages, lawsuits, and/or liabilities or claims arising whether directly or indirectly from or related to any and all claims made by or against any of the released party due to injury, loss, or death from or related to COVID-19.
